Abuse of consumer trust in the digital market and the green market: the case of green washing in the Italian legal system
2022
Purpose The purpose of this paper is to offer some reflection on the abuse of consumer trust and the importance of control of information in the digital market and the green market. The role of the consumer as the arbiter of the market is fundamental. The abuse of consumer confidence depends, in fact, on the spread of stereotyped messages and vague and generic formulas aimed at hiding a dangerous vacuum of protection. In both markets, it is a question of giving the consumer the necessary tools to monitor the transparency of the criteria used by the trader to classify a product according to its characteristics. Design/methodology/approach Based on the analysis of an Italian case law and the…
Oneri di sbilanciamento (diritto dell'energia)
2018
The article aims to explore to what extent consumers protection, as principle constitutionally guaranteed by art.38 of EU’s Charter of Fundamental Rights, should affect the rules governing the electricity dispatching service and the balancing system. On a market such as the electricity market, where demand is inflexible and the product concerned cannot be stored, electricity dispatching service is designed to ensure that, within the national transmission system, the supply of electricity matches demand, thereby guaranteeing security and continuity in the energy supply. Transparent market-based mechanisms for the supply and purchase of electricity needs to be combined with balancing measures…
RAPPRESENTANZA E DIRITTO EUROPEO
2011
Peer to Consumer Lending
2022
Peer to consumer lending represents an alternative form of financing characterized, within the crowdfunding genus, by the collecting of credit offers to be matched with borrowing demand through a digital platform. The essay focuses on legal analysis of some aspects of the structure and the functioning of lending marketplaces operating in the sector at stake. The Author argues how this business model – especially when the phenomenon involves consumers and, more generally, non-professionals counterparts – may be critical as regards to the classical cathegories and concepts ruling the lending/borrowing discourse.

The Protection of the Weaker Parties in the Platform Economy
2018
Known by many names – platform, sharing, peer-to-peer (p2p), collaborative economy, and so on - entirely new business models have emerged in recent years, whereby online platforms use digital technologies to connect distinct groups of users in order to facilitate transactions for the exchange of assets and services. This dramatic shift in business organisation and market structure has opened an intense debate on the persisting need for those regulatory measures that typically protect the weaker party in bilateral business-to-consumer transactions. Widespread calls for a more “levelled playing field” makes a strong argument for reconsidering the scope of regulation and delegating regulatory …

Trasparenza del mercato, tutela del consumatore e green washing
2022
